What the expert witness expects of his legal team
By Emile Woolf, Senior Partner, Kingston Smith
Having acted as an accountancy expert in a wide range of disputes over nigh on 25 years, I recognise the critical nature of the relationship between expert and legal team in ensuring the smooth running of the litigation process from start to finish

Justice Reinvestment: a new approach to imprisonment and public safety
By Andrew Coyle, Professor of Prison Studies, Kings College
The average cost of keeping a person in prison for one year is around £40,000. That means that the cost to the taxpayer of maintaining a prison with 700 places will be around £28 million per year

Why is the reintroduction of means-testing for criminal legal aid such a cause for concern?
By Dr Peter Kenway, Director, New Policy Institute
The first is whether this was what parliament intended. It is clear from Hansard that parliament did not object in principle to means testing for criminal legal aid. But there is nothing in the debate on the primary legislation to suggest that parliament knew that the implementation of means-testing would remove eligibility for legal aid from so many

The Bar Vocational Course: money well spent?
By Tom Cross, BVC Student
“I suspect that a significant number of those who sit on pupillage interview panels would openly state that a candidate’ s performance on the Bar Vocational Course, or BVC, is one of the least important factors that are considered in determining applications”.

Meadow, the media and immunity from suit
By Mark James, barrister, 1 Temple Gardens and Penny Harper, Director, Bond Solon.
At the end of October 2006 the Court of Appeal allowed the GMC’s appeal against the by now notorious decision of Collins J in GMC v Meadow, [2007] 1 All ER 1 (CA); [2006] 2 All ER 329 (Admin). The CA held that an expert witness has no immunity from disciplinary proceedings brought by his professional body arising out of his conduct as an expert witness.

Management of compensation claims- Why a well managed compensation claim can be part of the rehabilitation process
By Bill Braithwaite QC, Head of Exchange Chambers
In my opinion, the legal management of a claim can and should start, subject to the family’s wishes, whilst the patient is in hospital. That may sound controversial (shades of ambulance chasing) but in fact it is precisely the reverset.

Is the Bar fit for purpose in the twenty-first century?
Barbara Hewson says the Bar must change its working methods to survive
On 8 January 2007, the new Chairman of the Bar told the Financial Times: “"Where we're missing out is ordinary working-class people, from all racial and social origins, who think the Bar is unattainable."

EU Intellectual Property Enforcement Directive – Devil in the Detail
By Gregory J. Urbanchuk MSc
Historically, when it came to the enforcement of Intellectual Property (“IP”) rights in the European Union (“EU”), local rules applied. In the context of enforcement rules, the remedies available for infringement were quantified by reference to the rules of the jurisdiction in question, which often differed amongst Member States.

Developments in 2007 for expert witnesses in the family courts
By Penny Cooper, Associate Dean at The City Law School

“Government ministers are currently considering responses to two public consultations which make proposals for major changes in the family courts and in how experts are instructed. There is the added complication that the combined effect of changes may do nothing to reduce the shortage of medical experts in child protection cases. ” .

By Stephen Bedford, Managing Director, Conical, fellow of the Chartered Institute of Marketing

“This article is based on practical experience of managing chambers marketing and information drawn from a Conical research report into barrister marketing practices. The article should be of use to barristers responsible for marketing and general management of chambers as well as the clerking team.”
